The attorneys for Josh Abrams and Kate Peter filed a motion to extend their deadline to respond to Jose “Chille” DeCastro’s amended complaint by 21 days as he has stated that he intends to make a second amended complaint, naming YouTube and YouTube employees as new co-defendants.
As expected from her previous four rulings on the matter, Judge Allison D. Burroughs rejected Jose "Chille" DeCastro's fifth attempt at a motion to reconsider her decision denying his claim that he filed his motion to voluntarily dismiss his case against Kate Peter and Josh Abrams before Peter and Abrams submitted their counter claims in the case.
DeCastro revived his demand that the judge reconsider his voluntary motion to dismiss. DeCastro maintains his claim that the electronic filing system screwed up while he was vacationing in Colombia and did not properly process his motion to dismiss before defendants Peter and Abrams were able to file their responses to his original complaint.
Jose "Chille" DeCastro returned to social media on Tuesday, November 29, 2022, with a series of subdued posts across Facebook, Twitter, YouTube and Instagram. The posts were a mix of his anti-vax and anti-government views with a notable absence of negative engagement.
