A late Friday filing by Wayne Julia, Deputy Clerk of the United States District Court of the District of Nevada, informed Jose “Chille” DeCastro that his lawsuit against the State of Nevada and an LVMPD Officer named Citco will be dismissed if DeCastro does not provide proof of service.
The notice indicated that DeCastro filed his second amended complaint on November 27, 2023, adding Officer Citco. He then needed to show proof of service to all of the existing defendants along with Citco for the newly amended complaint. He apparently properly served all the existing defendants except for the State of Nevada.
DeCastro has until May 5, 2024, to show proof of service of both Officer Citco and the State of Nevada or his case against both will be dismissed without prejudice.
In the event that DeCastro fails to provide proof of service, the lawsuit against the rest of the defendants will continue. DeCastro would need to file a separate lawsuit against Officer Citco and the State of Nevada if he wished to pursue the charges again.
Officer Citco was not involved in the March 15, 2023, incident that spawned the lawsuit. He had encountered DeCastro at a traffic stop in January of 2023. DeCastro alluded to him as part of a conspiracy by the LVMPD against DeCastro but did not specify what Citco did for inclusion in the lawsuit.
