Jose “Chille” DeCastro was shocked on Monday as Judge Anne Zimmerman denied his motion for bail or release on his own personal recognizance following his conviction on obstructing an officer and interfering in a traffic stop.
DeCastro’s attorney, Christopher Oram, argued that DeCastro experienced a shock to the system since being sentenced to jail in March and was extremely remorseful for his actions. Oram was seeking bail of between $10,000 and $20,000 to allow DeCastro to be free until his July appeal hearing.
Oran further argued that DeCastro has no real criminal history and no felony or gross misdemeanor convictions. He also attempted to argue that there were “significant first amendment issues” about filming of the police that were not raised at DeCastro’s trial that should be addressed upon appeal.
He then offered DeCastro to provide a live apology to the court to show that he was indeed apologetic for his actions at his last appearance in court.
Deputy District Attorney Agnes Botelho countered that DeCastro had the opportunity to raise the first amendment issues in court, that both his previous lawyer, Michael Mee, and DeCastro himself raised the issue as part of the defense. While the Judge did not side with them on the issue, they were litigated and found wanting at the previous hearing.
She stood by the Judge’s sentencing and corrected Oran’s claim that DeCastro had no significant criminal history, pointing out that DeCastro has multiple recent incidents with police and is set to go on trial for the same obstruction of an officer charges that he had faced in this case from a February 14, 2024, arrest in Las Vegas.
Before issuing her ruling, Judge Zimmerman also noted that besides the February 14 arrest, DeCastro is facing charges from an incident in Goodsprings, Nevada, and that her sentencing was not based on DeCastro’s behavior in court.
She pointed out that while the defense could put DeCastro in front of her to apologize, she has reviewed his recent videos made from phone calls while he was incarcerated where he was anything but apologetic in his statements towards his case and towards the judge.
Oran then withdrew his offer for DeCastro to apologize to the judge.
Judge Zimmerman ultimately ruled against Oran’s motion and DeCastro will remain in jail until at least his July appeals hearing.
