Jose “Chille” DeCastro delighted observers on Monday as his attorney, Christopher Oram, filed what could only be described as an over blown mess of conflicting statements, untruths and overreach in his appeals brief to Nevada’s Eight Judicial District Appeals Court.
Oram is representing DeCastro in his appeal of his conviction of sentence to the Clark County Detention Center after being found guilty of obstructing an officer and interfering in a crime scene in March. His Monday filing, made on the last day he was eligible to file his opening arguments, violated the court’s written rules as he submitted 29 written pages, 19 pages over the Court’s limit.
The attorney accompanied his filing with a request of the court to allow him to go over the page limit, which had not been granted by the Judge Michelle Leavitt, before he filed his opening statement.
If allowed, Oram’s work has been criticized for parroting statements DeCastro has been making in his jail house recordings released to his YouTube channel in recent weeks.
The four main points focus on DeCastro’s claim that his right to record as a journalist were violated in the ruling, that Justice of the Peace Ann Zimmerman was biased in her ruling against him, that the statutes used to find his guilt were overly vague, and that he had ineffective legal representation in the case.
All the points that DeCastro made come directly from his statements since his conviction and offered little to no actual basis in law to back their contentions. As observers noted, the document feels as if DeCastro wrote it himself, with someone editing it to clean up his typos and to add an occasional comedic quip to the mix.
Oram has reportedly been paid a $25,000.00 flat fee to handle DeCastro’s appeal and is expected to be on hand when the appeal is heard on July 10, 2024. The prosecution now has 30 days to reply to DeCastro’s opening brief, then DeCastro’s team will have 30 days to rebut the prosecution’s reply before the trial date.
