Jose “Chille” DeCastro was found guilty of “No Tail Lamp/Defective Tail Lamp-Night” by default judgement on Wednesday in Ozaukee County, WI, as he did not appear in court to contest the charges.

The YouTuber was famously pulled over in late October after visiting activist Garrett “Press with Rancor” Van Nett and attending a meeting of the Delta County, MI, Board of Commissioners. DeCastro was on his way to an airport in Wisconsin to return his rental car when a police officer pulled him over for a non-working taillight.
Instead of immediately stopping, DeCastro put one of his hands out the window to indicate that he was pulling over and drove over a mile with police in pursuit before stopping at a gas station. DeCastro, who had no idea he was in Wisconsin instead of Michigan, then confronted police officers and received a citation for the infraction under Wisconsin Statute 347.13(1).
347.13(1) (1) No person shall operate a motor vehicle, mobile home or trailer or semitrailer upon a highway during hours of darkness unless such motor vehicle, mobile home or trailer or semitrailer is equipped with at least one tail lamp mounted on the rear which, when lighted during hours of darkness, emits a red light plainly visible from a distance of 500 feet to the rear. No tail lamp shall have any type of decorative covering that restricts the amount of light emitted when the tail lamp is in use. No vehicle originally equipped at the time of manufacture and sale with 2 tail lamps shall be operated upon a highway during hours of darkness unless both such lamps are in good working order. This subsection does not apply to any type of decorative covering originally equipped on the vehicle at the time of manufacture and sale.
Video from DeCastro’s coverage of the incident seemed to reveal that his taillight appeared to be working at the time of the stop. Observers noted that DeCastro had his best chance of winning a court case this year as the video may have been used to discredit the officer’s testimony.
Instead, with DeCastro’s decision not to contest the citation, he now owes the county $162.70, which is due on November 28, 2023.
