Jose “Chille” DeCastro’s recent admission to staging the circumstances of his March 2023 arrest for interference in a traffic stop and obstruction of a police officer may have severe consequences for the YouTuber as it was cited in recent filings in his Las Vegas based civil rights lawsuit.
DeCastro is suing the Las Vegas Metro Police department over the arrest and alleged torture he experienced after an encounter with police last year that he claims left him permanently injured. In a recent live stream, DeCastro bragged that he was holding out for a “seven figure” settlement in the case as he had instigated the encounter to provoke the police into an arrest and a lawsuit.
At face value, it was one of the many claims and bold statements that DeCastro makes every night in his live infomercials on his YouTube channel, in court, however, it is an admission of guilt that may end up sinking both his legal defense in his criminal case (scheduled for February 26, 2024) and his federal civil rights lawsuit.
Video evidence of DeCastro’s statements was introduced on Friday in the latest filing by the defense in his case, a 33-page reply to DeCastro’s lawyer’s response to the defense’s recent Motion to Dismiss the case. In the filing, the defense homed in on DeCastro’s admissions that he derogates and degrades police officers in the scope of their duties and provoked the arrest by officers in the Las Vegas case.
While unlikely to destroy his federal civil rights lawsuit, his self-recorded apparent admission of guilt – while stating his intent to solicit a “seven figure” payout from the LVMPD – will more than likely directly impact his up-coming criminal trial as Michael Mee, again representing DeCastro, will have his hands full in redirecting the meaning of DeCastro’s recorded statements.
Returning to the federal civil rights case, more problems face Mee as a key element to Mee’s response to the motion to dismiss came in the fact that not all the declarations from the officers in the case as to the authenticity of their bodycam footage was signed and dated by the officers.
Mee’s argument didn’t state why this fact was relevant in the law, just that the footage should be disqualified because of the lack of authenticity. The defense corrected this apparent oversight with newly signed statements from each officer that the bodycam footage was authentic.
Also at issue is Mee’s statements that the footage presented can’t accurately show what happened to support DeCastro’s claim that he was punched in the groin during a search at the crime scene or that he was “tortured” while being restrained by officers.
Mee provided no evidence to back his claims, and again, relied on the lack of authentication to discredit the body worn camera footage and cited no evidence that the officers violated the law in their handling of his client during the arrest.
The rest of the document responds to an on-going pattern of DeCastro (and now Mee via DeCastro) stating a claim, as seen in his previous Federal and State level lawsuits, but either not directing that claim against a specific person or stating the claim providing legal reasoning behind the claim for the court to move forward with his claim, and sometimes both.
While DeCastro had previously relied on the fact that he was representing himself and was allowed to make significant mistakes, he is now represented by a professional attorney who no longer has that advantage.
The defense is seeking the Court to grant a summary judgment on DeCastro’s claims in their favor.
