Mark D. Zuckerman, writing on behalf of both the City of New York and SeanPaul “Long Island Audit” Reyes (LIA), wrote to Judge Jessica G.L. Clarke on Tuesday asking for a two-week delay to finish the discovery process in the long-running trial.
Zuckerman claimed that LIA’s attorneys agreed to the delay based on the sheer volume of documents produced by the NYPD in the discovery process. Both sides need time to go through the documents and come up with a plan for a confidentiality order as some of the documents produced contain information not for public consumption.
The case is also hindered from progressing as Judge Clarke’s order to suspend a preliminary injunction on the NYPD policy to block filming in NYPD precincts is reviewed by the Appeals Court for the Second Circuit.
There is no estimation for when the Second Circuit will return a ruling. They have, however, given LIA the temporary ability to film within NYPD facilities while the appeal is still pending.
If granted, the discovery process deadline would be moved from April 5, 2024, to April 19, 2024.
