With Friday’s final pre-trial hearing in the Karen Read murder case pending, both the prosecution and defense flooded the Court with their final pre-trial motions on Wednesday with some surprising results including the exclusion of Aidan “Turtleboy” Kearney by both sides.
Kearney has been both a unifying and divisive figure in the murder case as Read has been accused by many of using her friendship with the blogger to promote her agenda and leak information from the defense to the public through his leadership of the so-called “Free Karen Read” movement that has resulted in him facing felony charges of witness intimidation.
In what appears to be the prosecution’s attempt to preserve their pending legal action against Kearny, the prosecution filed a motion to exclude mention of the blogger from the trial as he was not a witness to the murder case itself. They’ve also indicated that they will instruct their witnesses not to describe the constant harassment they’ve allegedly faced from Kearney.
Likewise, the defense has requested that all references to the alleged harassment and intimidation by blogger Kearney be excluded from the trial. Their argument claims that there is significant overlap between the witnesses in the two open criminal cases and that Kearney is not a witness to the charges that Read faces in the murder trial.
Other notable requests from the defense include a trip by the jury in the presence of Read to the places she and alleged victim John O’Keefe went to the night of his murder, exclusion of her blood alcohol levels from the night of the murder, exclusion of “bad character” testimony, and sanctions against the prosecution for failure to produce timely evidence from DNA testing done by Bode Technology.
On the prosecution side, they have a motion to exclude Read’s “bad character” with the caveat of the request to introduce it to counter “good character” witnesses by Read’s defense. They’re also seeking a limit to character attacks on their witnesses, no mention of the FBI investigation into the investigation of the murder, no defense expert testimony regarding alternate theories on how scientific studies work, and a crackdown on the so-called “OJ Defense” in which Read would present alternate theories of who committed the murder.
