Continuing a very bad week for the defense team in the Karen Read murder case, Judge Beverly J. Cannone denied their Motion for Sanctions and for the Disqualification of Norfolk District Attorney Michael Morrissey.
The ruling essentially states that while DA Morrissey made statements that were inconsistent with the Rules of Professional Comment in his statement to the Commonwealth in response to the Defense’s accusations against witnesses in the case, he did commit acts that were on the level of egregious misconduct.
Judge Cannone further found that DA Morrissey’s office did not hide the disclosure of or evidence from a Federal Inquiry into the investigation of the prosecution of Karen Read. Stating that the defense became aware of the inquiry around the same time as the DA, and avoiding accusations that the Defense actually requested federal agents get involved in the case using a previous connection between Karen Read and federal agencies, Cannone ruled that the DA’s office offered what they knew about the investigation in compliance with the law.
While Cannone denied the prosecutions attempt to restrict extrajudicial statements through the imposing of a “gag order” on the defense, Cannone singled out the defense in her ruling. She reminded them that it was improper to misrepresent or distort facts in impounded documents, and to file and argue motions without required supporting documentation.
Friday’s ruling comes as the defense had multiple rulings go against them in the final weeks leading up to Karen Read’s trial for second degree murder of Michael O’Keefe, including a denial of their motion to dismiss the case.
Read’s trial is set to begin in Mid-April 2024.
