The first of two sets of replies to Jose “Chille” DeCastro’s appeal of his recently dismissed lawsuit against police officers from Ironton, Ohio and Lawrence County, Ohio, was released on Thursday, with the filing of the reply from the Lawrence County defendants.
The Lawrence County defendants have been largely ignored by DeCastro throughout his lawsuit as DeCastro all-but eliminated mention of them in his first amended complaint. After DeCastro ignored multiple show cause motions and statements and had the ability to update and clarify his accusations against them, he waited until after the lawsuit was dismissed to correct his oversight.
In his appeal, DeCastro raises twenty-four reasons why he believed the District Court applied the wrong law along with forty issues he is raising with his appeal.
Most of those reasons and issues in relation to the Lawrence County defendants either relate to his claim that he was unfairly denied the ability to file a second amended complaint after the case was dismissed, or that the court errored in granting the defendant’s motion to dismiss the case against them after he failed to name them in his original amended complaint.
The Lawrence County defendants are asking the court to deny DeCastro’s appeal and have added a request for oral arguments to explain their cause should require further statements from both parties. The arguments are expected to be held in person and may result in the resolution of an outstanding warrant for DeCastro’s arrest in relation to the case.
It is unclear if DeCastro would agree to in-person oral arguments as DeCastro fled Ohio in 2023 following a hearing in his trial for the trespassing charges that sparked the civil suit.
In multiple statements since then, along with a highly fictionalized YouTube series recounting his days as “the protector of Ironton, Ohio,” DeCastro has stated he felt his life was in danger if he returned to Ohio, with a vast conspiracy involving police and judges plotting his demise.
This filing was the first of two defensive filings expected in response to DeCastro’s appellate brief, as the group of Ironton defendants have a deadline to file their individual reply to the motion by February 5, 2024.
