Monday saw mixed results in the on-going murder trial of Karen Read, who is accused of running into boyfriend John O’Keefe and leaving him for dead in a snowstorm in Canton, Massachusetts, in 2022.
The defense gained early points for pointing out the unusual techniques Canton police used at the crime scene during testimony from several police officers during the morning session. As none of the officers on the scene had significant experience with processing a crime scene during an active snowstorm, unusual methods were used to collect evidence.
On the stand, police witnesses admitted they used red solo cups to scoop up blood covered snow at the crime scene were transported in a grocery store paper bag from the crime scene instead of using sterile containers and an official evidence bag in processing the crime scene.
The use of a leaf blower was used to expose evidence on the scene; however, John O’Keefe’s hat and missing shoe were not found during the chaotic search. While a minor point, the defense made strides in their on-going contention that evidence was planted at the scene as again, O’Keefe’s missing clothing was not found in the search, only to be discovered later by investigators in plain sight.
The prosecution scored points as witnesses pushed back against defense attorney Alan Jackson’s flamboyant snark in his cross examinations of witnesses. Jackson has demonstrated that his style is to use the rule of three to set up witnesses to ultimately unintentionally agree with his points.
Jackson, who has earned the ire of Judge Beverly J. Cannone on multiple occasions, tends to make meandering but agreeable statements or questions to witnesses, reword those statements or questions slightly to again get a positive statement from the witness, and then totally rearrange the statement or question completely in an attempt to deceive the witness into responding positively to his question or statement.
The Canton police officers who testified during Monday’s hearing seemed to be prepared for Jackson, often quipping back at him during his cross examination and leaving him little to work with at times.
Defense Attorney David Yannetti may have also given a perceived win to the prosecution at the start of the hearing and outside of the presence of the jury with a flamboyant demand to hold witness Katie McLaughlin on perjury charges as he claimed that new pictures of McLaughlin with Caitlyn Albert, daughter of homeowner Brian Albert, emerged over the weekend.
Yannetti’s dramatic demand of action by Judge Cannone felt like a made for TV movie drama as Yannetti seemed more concerned about addressing his statement to the TV camera than he did pursuing the action with the Judge.
Judge Cannone shut down Yannetti’s demand for perjury charges quickly and moved the proceedings forward, leaving those watching with a sense that Yannetti was causing drama to cause drama rather than over an actual concern over Mclaughlin’s testimony.
