A recent motion to dismiss SeanPaul “Long Island Audit” Reyes (LIA) lawsuit against the New York City Police Department was denied on Wednesday by Judge Jessica G. L. Clarke.
Judge Jessica G. L. Clarke wrote:
ORDER In light of the Amended Complaint (ECF No. 67 ) and Defendant’s motion to dismiss (ECF No. 73 ), the motion for judgment on the pleadings at ECF No. 57 is hereby DENIED as moot. (HEREBY ORDERED by Judge Jessica G. L. Clarke)(Text Only Order) (Clarke, Jessica)
The motion to dismiss was denied because the case moved forward before the judge could rule on the previous motion to dismiss. Reyes’ attorney filed a newly amended complaint, and the defense then filed a motion to dismiss the amended complaint, which is currently being considered by Judge Clarke.
