Lawyers for the New York City Police Department withdrew their request to have a jury determine the outcome of the case presented by SeanPaul “Long Island Audit” Reyes (LIA) on Monday, ending the puzzling request in a case that involved no monetary request for damages.
LIA is currently suing the NYPD for their enforcement of a policy against recording in public areas of NYPD precincts. The YouTuber claims that by enforcing the policy the police are in direct violation of New York City and State’s individual “Right to Record” laws, which seemingly overrule previous rulings which would allow the NYPD to define public, limited and non-public forums within their facilities.
The jury request was made by former lead counsel for the NYPD Gregory Musso before Musso was removed from his position. Judge Jessica G.L. Clarke had criticized the request as no monetary damages were involved in the lawsuit and had given the NYPD until the end of January to decide if the request was warranted.
Current lead council for the NYPD, Mark D. Zuckerman indicated in a letter to Judge Clarke on Monday that the NYPD would not be seeking a trial by petit jury or a trial to the court with an advisory jury.
The trial is currently awaiting action by plaintiff’s counsel, Andrew Case, in his recent botched attempt to file an amended complaint. Case filed the amended complaint before receiving permission to do so by the court or from the defense, resulting in Case missing the set deadline for filing amended complaints.
It is unclear if Case will be allowed to move forward with his attempts and we will update this story once a resolution is announced.
