Floyd Wallace’s case against the Las Vegas Metro Police Department (LVMPD) was dismissed without prejudice on Wednesday as Judge Andrew P. Gordon honored Wallace’s request to dismiss the lawsuit even though Wallace failed to clearly state which defendants should be dismissed from the case.
Wallace filed the lawsuit against the LVMPD in May of 2023 after his arrest at a LVMPD substation. While the charges from the incident were dropped, Wallace paired with Jose “Chille” DeCastro to proclaim his innocence and file his lawsuit.
The lawsuit was functionally identical to DeCastro’s own lawsuit against the LVMPD and according to the former Delete Lawz Clips Reloaded, Collin “Project Constitution” Campbell, DeCastro’s legal team worked the case with Wallace, raising suspicion that DeCastro himself was attempting to practice law without a license.
A split in the late summer between DeCastro and Wallace came after the wife of YouTuber Jason Dollarhide, Heather Dollarhide, made accusations that Wallace sexually assaulted her and a friend at her home when he visited her to do an interview.
Campbell’s version of the story claimed that DeCastro paid off Heather Dollarhide to stop her from going to the police. At the same time DeCastro then cut ties with the Dollarhide family and with Wallace and apparently attempted to get out of his involvement in Wallace’s lawsuit.
Wallace’s last few filings with the Court asked for multiple delays in the lawsuit as he sought pro bono legal representation. As he was unable to find proper representation, Wallace asked for the judge to dismiss the case with prejudice and informed the court that he would be refiling at a later date.
The dismissal request was controversial as Wallace forgot to request that defendant the State of Nevada be dismissed from the lawsuit. Judge Gordon gave Wallace until November 3, 2023, to correct the error. When he failed to reply, Gordon dismissed the lawsuit against all defendants.
