Friday evening saw a late release of the court minutes from Thursday’s hearing for Jose “Chille” DeCastro’s California based civil lawsuit against Kate Peter, Michael “Blue Bacon” Pierattini, David “Team Skeptic” Omo and Daniel Clement.
DeCastro was not present at Thursday’s hearing scheduled by Pierattini’s lawyer, R. Paul Katrinak, because of that, Judge H. Jay Ford III issued a tentative ruling that saw him deny Pierattini’s motion for monetary sanctions against DeCastro.
Pierattini was seeking $4,560.00 in sanctions to punish DeCastro for refusing to answer Pierattini’s extensive list of special interrogatories and production of documents in the discovery process. In a rare win for DeCastro, Judge Ford ruled that DeCastro acted properly in refusing to reply as Pierattini’s demands were beyond of the scope of what DeCastro could be expected to answer in one setting.
Judge Ford then ruled that DeCastro must provide full and complete answers to 43 previously unanswered requests for admission within 30 days of the ruling. DeCastro was also ordered to respond to the first 27 special interrogatories within 30 days, while giving Pierattini the opportunity to request responses from DeCastro of another 23 special interrogatories.
Pierattini was granted another partial victory as Judge Ford ruled that DeCastro must produce 14 of the documents requested by the defense within 30 days. Ford picked documents that would specifically help Pierattini obtain discovery from DeCastro that would bring answers to questions brought in his demands for special interrogatory responses.
DeCastro was also ordered to confirm that the address he submitted in his change of address form (The Clark County Detention Center, 330 S. Casino Center Blvd., Las Vegas, NV 89101) was a permanent address and explain why DeCastro is still using his Santa Monica, California, address in his court filings.
Once DeCastro provides his current living address to the Court, he has been ordered to sit for a deposition with Katrinak.
The rest of the hearings set for May 2, 2024, were then continued to June 18, 2024. It is unclear what will happen to the currently scheduled May 7, 2024, hearing for sanctions, or the May 16 hearings for DeCastro’s motion to compel discovery from Pierattini or his Hearing on Demurrer – without motion to Strike.
While Pierattini is the only defendant actively engaging with DeCastro and any of the requestion monetary sanctions will go directly to Pierattini through his attorney, his partial victory on Thursday may set the stage for the entire lawsuit to be dismissed with a motion for summary judgement on the table at sent to be heard later this year.
