Jose “Chille” DeCastro filed a Motion to Demurrer without Motion to Strike on Friday, adding a new hearing to the packed court schedule in his lawsuit against Kate Peter, Team Skeptic, Daniel Clement and Michael “Blue Bacon” Pierattini.
The motion essentially is a complaint against Pierattini’s recent filing of a response to DeCastro’s first amended complaint. In his response, Pierattini’s lawyer, R. Paul Katrinak, denied every allegation made by DeCastro, and claimed that DeCastro sustained no damages by any action taken by Pierattini.
DeCastro’s complaint goes to the fact that Katrinak used generic defenses in his responses, a position Katrinak explained in his recent 700-pages of filings to the court that he was forced to take as DeCastro complaint holds all defendants equally responsible for all alleged wrongdoing without stating a case against the defendants.
Katrinak’s filings also contend that DeCastro ignored the discovery process completely to continue this pattern, using generic objections of his own to deny further requests to provide specific allegations against Pierattini, proof of his action or even a list of witnesses to Pierattini’s alleged actions.
DeCastro has scheduled a hearing on June 4, 2024, for the Court to hear the matter.
