There are multiple updates in Jose “Chille” DeCastro’s recent conviction of obstruction and interference in a traffic stop as DeCastro has filed an appeal of that conviction.
DeCastro filed his notice of appeal on Tuesday, within hours of his transfer to the Clarke Count Detention facility where he will reside for the duration of his sentence. Due to Nevada state policy, DeCastro is listed as currently scheduled for release on August 3, 2024, after serving 76% of his sentence. This takes into account good behavior and standard sentencing guidelines to prevent overcrowding in the facility.
DeleteLawz.com immediately went offline on Tuesday after the verdict. It is unclear if this was intentional or a mistake on DeCastro’s assistant’s part, but this inadvertently robbed DeCastro of his primary revenue stream – his online shop – during his incarceration.
The post apparently confirmed speculation that DeCastro’s financial backers have stuck with him during his incarceration and are willing to fund his commissary during his stay in the detention center.
It also highlights DeCastro’s plight in raising funds for Garrett “Press with Rancor” Van Nett. DeCastro signed a contract with Van Nett’s lawyer earlier in March promising to pay $60,000.00 in $6,000.00 installments for legal services. DeCastro was reportedly at $2,000.00 in donations for next month’s payment at the time of his sentencing.
Former DeCastro partner, Collin “Project Constitution” Campbell, speculated that the site may be down due to a DMCA violation. He announced on Wednesday in a post on Kate Peter’s Discord that he had filed a Digital Millennium Copyright Act (DMCA) claim with DeCastro’s web site provider stating that he designed various products on DeCastro’s site that are involved in an active copyright dispute.

DeCastro’s incarceration has not yet impacted on his on-going lawsuits. The YouTuber filed a new motion in his lawsuit against Kate Peter, David “Team Skeptic” Omo, Daniel Clement and Michael “Blue Bacon” Pierattini (Bacon) on Tuesday in support of his scheduled hearing on Friday to dispute the tentative ruling from earlier in the month imposing sanctions in the case.
The YouTuber argued that the Court acted improperly in the March 7, 2024, hearing and did not give him sufficient time to argue against sanctions. He also claimed that the court lacks jurisdiction to grant sanctions and abused its discretion in awarding sanctions to Bacon.
DeCastro’s motion to reconsider is scheduled for a hearing on Friday. His motion for sanctions against Bacon is scheduled for May 5, 2024.
