Attorneys for James “James Freeman” Springer (Freeman) filed their response on Wednesday to a recent motion to dismiss their recently filed amended complaint in their lawsuit against New Mexico’s Sevent District Court.
The defense’s motion to dismiss was based on the contention that while Freeman’s attorneys had modified their original complaint, they had made minor changes at best and did not satisfy the Judge’s order to modify their complaint to satisfy the legal burden she claims it was lacking.
In response to that motion, Freeman’s attorney claims that the changes made to the complaint satisfy the deficiencies set forth by the Court and that the Defendant’s motion to dismiss did not state what was deficient in the amended complaint or why it should be dismissed.
They further argue that Freeman had no due process before the Seventh District Court took action against him and removed his ability to attend court proceedings within courthouses in the Seventh District without a police escort.
Freeman’s attorneys are seeking the denial of the dismissal and the continuation of the lawsuit against the Seventh District.
