Lawyers for the Seventh Judicial District rebutted James “James Freeman” Springer’s (Freeman) arguments against granting their motion to dismiss on Wednesday with a new filing.
Freeman has been suing the entire Seventh Judicial District for the past year over their requirement that he have a police escort when visiting court facilities in the Seventh Judicial District after a series of incidents last year in which Freeman is alleged to have made threats against court personnel.
The defense essentially reiterated their claims that despite multiple attempts to amend his original complaint, Freeman has yet to state a claim as to how any of the named defendants violated his rights. They also contend that Freeman has also failed to allege how any of the named defendants personally participated in any of the actions giving rise to his claims.
In their response, they also claimed Freeman failed to argue any allegations that would qualify for a first amendment retaliation claim. They pointed out that Freeman failed to state why his alleged disruption of a hearing that was in progress, refusing to wear a mask when a mask mandate was in effect, secretly recording hearings on his cell phone or harassing and threatening court staff were constitutionally protected activities.
Finally, the motion indicates that Freeman failed to show how he was damaged by the actions of the Seventh District to limit his access to the court facilities. Freeman, they argue, is still permitted to access the facilities, and must abide by the same rules as everyone else who visits. He has further shown through continued visits and confrontations aired on his YouTube channel that he can come and go from the facilities at will with little to no impedance of his activities.
The Defendants are seeking a dismissal of Freeman’s second amended complaint with prejudice.
