A Federal Judge delivered a blow to James “James Freeman” Springer’s (Freeman) lawsuit against New Mexico’s Seventh District Court on Friday by denying his request to file a surreply and quashing his service of the majority of the defendants in the lawsuit.
Judge Margaret Strickland ruled that Freeman did not properly serve all the defendants except for defendant Susan Rossignol and gave the YouTuber twenty-one days to properly serve the defendants or face possible dismissal without prejudice of his claims against them.
The Judge then threw out Freeman’s charges in Counts II and III of his amended complaint regarding Rossingnol, stating that Freeman failed to make a claim against her. Freeman was given leave to file a Second Amended Complaint within 21 days to address this matter.
Strickland also ruled that the defense’s future motions for sanctions for Freeman’s alleged spoilation of evidence should be filed as a discovery motion. She also refused to consider a dismissal of the case as a sanction for Freeman’s alleged continuation of harassment against the defendants and their attorneys, directing them to pursue remedies available to them under New Mexico law.
Finally, the Judge denied Freeman’s Renewed Opposed Expedited Motion for Leave and Extension of Time to File Surreply.
