Tuesday saw the release of filings by Michael “Blue Bacon” Pierattini’s (Bacon) lawyer, R. Paul Katrinak, in opposition to Jose “Chille” DeCastro’s opposition to sanctions imposed on him in a ruling by Judge H. Jay Ford III.
The motions, filed on March 21 but only released Tuesday by the California Superior Court website, savage DeCastro’s motion as frivolous and example of DeCastro’s continued outrageous conduct in the lawsuit.
DeCastro had originally filed a version of the lawsuit in a Massachusetts federal court last year naming Josh Abrams and Kate Peter in the lawsuit, claiming that the pair had harassed and defamed him.
In the Summer of 2023, DeCastro actively promoted the idea that Peter’s fans, who collectively were referred to as “The Masshole Troll Mafia,” were an actual organization with Peter leading a collective of criminals with set leadership positions, membership dues and membership assignments with the goal of harassing DeCastro.
After having multiple setbacks in the federal lawsuit, DeCastro would later pivot his lawsuit to focus on copyright infringement, naming YouTube and listing multiple YouTube creators and YouTube workers as John Doe defendants, dropping the harassment and defamation charges in the process.
That lawsuit was dismissed in July of 2023 after DeCastro failed to state a claim; this was an apparent strategy as DeCastro indicated on multiple occasions that he was not in the lawsuit to win a verdict, he was in the lawsuit to drain the defendants of funding until they had to capitulate and agree to his settlement terms.
DeCastro revived the harassment and defamation charges in a lawsuit last year, this time suing Peter in California Superior Court, dropping Abrams from his allegations, and adding Bacon, “Team Skeptic” David Omo and Daniel Clement, along with multiple John Doe defendants, in the lawsuit as members of the so-called Masshole Troll Mafia.
Bacon is the only defendant actively participating in the lawsuit as two of the three defendants (Omo and Clement) were ruled to not have been properly served by DeCastro. DeCastro does have a clerk’s ruling that Peter was in default, but that default has never been ratified by Judge Ford.
Katrinak’s filings refer to DeCastro’s delaying tactics and absurd contentions that the Masshole Troll Mafia is a real organization, with the attorney blasting DeCastro for failing to cooperate with discovery requests or provide direct evidence of wrongdoing by Bacon.
The filings were meant to be part of a hearing set for March 22 to discuss Judge Ford’s granting of sanctions of $1,600.00 against DeCastro. Ford, however, moved the hearing to March 21 and ruled against DeCastro’s claims.
No further action is expected on the filings at this time.
DeCastro is currently incarcerated at the Clark County, Nevada, detention center.
