In an unexpected move, Jose “Chille” DeCastro filed a motion on Monday with the Court hearing his criminal charges of obstructing an officer and interfering with a traffic stop on Tuesday, to reclassify his lawyer as a “standby council.”
During his arraignment hearing for new charges of obstructing an officer earlier on Tuesday, aired by Our Nevada Judges on their YouTube channel, DeCastro told Judge Cynthia Leung that he intended to represent himself at his trial, but he had a “standby council” who would handle motions and court appearances for him when his presence was not needed.
He later explained on his Monday live infomercial that he fully intended to make the opening and closing arguments in his cases but would use his “standby council” to question witnesses and handle court duties.
While “standby councils” are permitted under Nevada law, their use is normally for cases where a defendant chooses to represent themselves and are then only normally permitted to represent their client in the event that the court terminates the defendant’s self-representation.
It is unclear if DeCastro is attempting another delaying tactic for his Tuesday trial, as a specific hearing is required to allow DeCastro to replace his lawyer with self-representation. It is also unclear if the Court will allow DeCastro to join his own defense team and serve as a “tag team” with his hired attorney during the trial.
In more news from Monday’s infomercial, DeCastro announced that he hired a lawyer for YouTuber Wanda Mise, who is facing a bail revocation hearing in Indiana on Wednesday. DeCastro paid $3,000.00 to attorney Scott Adams to represent Mise, with a promise of another $3,000.00 to be paid within 45 days.
Airing his recording of his discussion with Adams, DeCastro could be heard as he attempted to hire Adams to represent him in Ohio to help resolve his criminal charges and his outstanding warrant for fleeing those charges. Adams declined as he is not licensed to practice law in Ohio but said that other members of his firm were licensed to practice in Ohio and may consider taking on DeCastro’s case.
After finishing playing the recording, DeCastro switched gears to his February 14, 2024, arrest for obstructing, claiming that he would be suing the prosecutor involved in the case for “malicious prosecution” along with the officers involved in his arrest. DeCastro stopped short of attacking the judge assigned in the case but seemed perturbed by her efforts to keep him on subject during the arraignment.
DeCastro’s trial for his March 15, 2023, arrest is scheduled for Tuesday, March 19, 2024, at 9:30AM PT. Our Nevada Judges will have coverage of the trial later in the day as it is not allowed to stream live from DeCastro’s case.
