In perhaps his most bizarre legal maneuver in some time, Jose “Chille” DeCastro essentially refiled his lawsuit against Ironton, Ohio, in Las Vegas, Nevada on Monday.
DeCastro filed suit against members of the Ironton, Ohio and Lawrence County, Ohio, police forces in 2022, claiming that his rights were violated in a 2022 arrest. That lawsuit had been dismissed twice, once for DeCastro missing a deadline to show cause in 2022, which was then reinstated after a late filing by DeCastro, and again in 2023 with a judgement in favor of the Lawrence County defendants for DeCastro’s failure to state a claim and a granting of a Judgement on the pleadings by the Ironton defendants.
After attempting to have the court reconsider the case based on “new evidence” involving YouTube’s atomic clock invalidating the trespassing charges, the Judge in the lawsuit eventually denied DeCastro’s request for reconsideration and DeCastro appealed the lawsuit to the Court of Appeals for the Sixth Circuit.
The original lawsuit is currently before the Court of Appeals for the Sixth Circuit with DeCastro, and both sets of defendants trading initial briefs. No rulings by the court have been made at this time.
DeCastro’s new Nevada filing greatly increases the narrative of what led to his arrest in Ironton, greatly mirroring the story told in his greatly fictionalized “American Patriot” YouTube channel. It also greatly expands the causes of action from four in the original lawsuit to 25 in the new Nevada based lawsuit.
It also contradicts itself many times as DeCastro provided updates to events occurring past the date of his arrest. These include Ironton Police Chief Pam Wagner’s retirement, Ironton Mayor Sam Cramblit’s DUI arrest, and DeCastro’s recent traffic infraction in Las Vegas that saw him briefly detained as he was flagged for “violent tendencies” within a police database, a flag allegedly placed by the Ironton police department.
The lawsuit itself claims that a Nevada court is the proper venue to hear the case as DeCastro now resides in Nevada, the conduct of the Ohio defendants impacts his potential customers, their defamatory conduct was targeted at law enforcement personnel in the forum, that DeCastro suffered economic harm in the forum and that the defendants operate a criminal syndicate giving Nevada jurisdiction over them.
DeCastro describes himself in the lawsuit as a resident of Nevada, yet also describes himself as his own council with mailing addresses in California. No mention is made of the previous dismissed lawsuit nor the pending appeal of that lawsuit. DeCastro is seeking $5,000,000 in punitive damages and $100,000 in compensatory damages and an unspecified amount in attorney’s fees.
According to DeCastro on his Tuesday night live infomercial, Monday’s filing was the first of many filings he has planned in the coming weeks. He claimed to have filed another suit on Tuesday, he planned to file a lawsuit against someone in Iowa, then another suit in State level court in Nevada, and a second lawsuit against the LVMPD for the above-mentioned detainment in the recent traffic stop.
