In an early Saturday ruling, Judge Jessica G.L. Clarke determined that YouTuber and activist SeanPaul “Long Island Audit” Reyes (LIA) must provide government issued identification when he attempts to audit NYPD precincts.
LIA gained the sole ability in New York City on Friday to record withing police precinct by the Court of Appeals for the Second Circuit as they continue to deliberate on the appeal over a stay on a temporary injunction that would block a NYPD police policy that allows police to trespass individuals for recording within police precincts.
Following Friday’s ruling by the Court of Appeals, the NYPD’s lawyers have requested that LIA use some form of identification when he uses his newly gained right to record. After LIA’s attorney initially said LIA would comply with the request, LIA refused to do so, insisting that he is so well known that he can just show police a copy of his YouTube videos to prove his identity.
Attorneys for the NYPD directly appealed to Judge Clarke, who ordered LIA to reply to their letter on Saturday. After LIA’s reply again stated that his videos would serve as identification, Judge Clarke ruled for the NYPD and LIA will be required to provide his government issued identification when he attempts to audit police precincts.
Judge Clarke wrote
“Application GRANTED. After considering the parties’ positions, the Court agrees that providing photo identification is a reasonable solution to allow the parties to comply with the Second Circuit’s decision to allow only Mr. Reyes to record in police precincts.”
LIA has not responded to the Judge’s decision as of press time.
It is unclear if he will be attempting to audit later today now that he has to present his identification.
