A second delay due to an overwhelming amount of discovery provided by the New York City Police Department was requested and granted by both sides of SeanPaul “Long Island Audits” (LIA) federal civil rights lawsuit on Monday.
The request was made by attorney Mark D. Zuckerman, representing the NYPD in conjunction with Reyes’ attorneys and sought to move the previously extended deadline for discovery responses and admissions to be extended from April 19, 2024, to May 3, 2024.
Judge Jessical G.L. Clarke granted the request to reset the dates on Monday afternoon.
Reyes is suing the NYPD over a standing order to trespass anyone who attempted to record within NYPD precincts. After being arrested multiple times last year, Reyes sued the NYPD as he claims his arrests for trespassing were illegal as the standing order conflicts with New York City and New York State’s so-called “right to record” laws.
The “right to record” laws were passed after the death of George Floyd in 2020 and guarantees New Yorkers the right to record police in public. Reyes claims that the laws further extend to police precincts, eliminating previously held precedents that police precincts were non-public forums.
Reyes is seeking the elimination of the NYPD policy and the ability to film within NYPD precincts.
