Jose “Chille” DeCastro filed a new motion in his case vs. Kate Peter, David “Team Skeptic” Omo, Daniel Clement, and Michael “Blue Bacon” Pierattini (Bacon), demanding $4,999.99 from Bacon for failing to respond to his discovery requests.
DeCastro’s motion was filed to support a hearing he has scheduled in California Superior Court on May 16, 2024, to attempt to get the court to compel Bacon to produce responsive documents to his discovery requests and issue monetary sanctions on Bacon.
The document stays with DeCastro’s previous allegations that is part of the so-called Masshole Troll Mafia, a fictional group which DeCastro claims is cyberstalking him and harassing him. The document requests apparently involve documents he’s seeking about the group with previous discovery including demands for names of and copies of communications with all members of the imaginary group.
DeCastro indicated that despite having no legal counsel on the case, the $4,999.99 figure included legal fees and fees for legal representation, “intentionally scheduling” a deposition when the opposition knew he had a conflict and failing to respond to his discovery request. He is also seeking punitive damages to discourage the behavior in the future.
DeCastro wrote, “In the present case, Plaintiff has incurred and will incur in excess of $500 in costs and attorney’s fees in connection with this Motion and enforcing this discovery due to filing fees, copying fees, and the cost of my time. Pursuant to Code of Civil Procedure §§ 2023.010, 2023.030, and 2031.310, and the power of this Court to impose monetary sanctions against the losing party on a motion to compel further responses, Plaintiff submits that given Plaintiff’s attempts to avoid having to file this motion, and Pierattini’s lack of compliance, sanctions should properly be awarded to Plaintiff and against Pierattini and his counsel in the amount of $4,999.99, to property deter such behavior in the future.”
The motion also states that DeCastro’s failed attempts to meet and confer with Bacon “were substantially more than what (Bacon) engaged in when this Court granted his motion for sanctions.”
While DeCastro has been suing Peter, Omo, and Clement along with Bacon for over a year, only Bacon is active in the case as he accepted service from DeCastro. DeCastro contends that all the defendants, including a multitude of “John Doe” defendants all are part of a “Troll Mafia” and are all equally responsible for all actions against him taken by the fictional group.
The next hearing in the case is set for May 2, 2024.

Reading this court case is like opening a door so some alternative dimension in time and space where this reality holds no sway. Thankfully, the case will be decided in this reality not the inner workings of chilli’s so call mind.
When faced with such a lolsuit. If it is filled within the state you live, send a registered letter to the judge saying, you won’t be playing with chilli and let the judge award him money. (Hint, and spoiler, it won’t happen as he has no case excepting the delusions of his feverish dream. If you are sued from another state, do not respond like BB and get sucked into this court case by accident. Just send a letter to the judge saying, you are not in his jurisdiction and the matter is not there either and then allow him to proceed without your being involved. Lastly, if you are Kate, just rely on the fact that chilli really does not know what he is doing. Hint, she was not served. No matter what chilli says.
