Tuesday saw quite a number of developments in SeanPaul “Long Island Audit” Reyes’ (LIA) on-going lawsuit against the New York City Police Department with LIA’s responses to the defense’s motion to dismiss.
Monday’s granting an extension to the plaintiff’s deadline to file their opposition to the defense’s motion to stay until a ruling on the motion to dismiss led to LIA’s attorneys filing their response to that motion to dismiss on Tuesday.
The response attempts to define LIA’s request to record within NYPD facilities to those areas that the public has access. While in at least one of the arrests LIA can be seen zooming in to record areas that were off-limits to the public, his attorneys again claim that he is only interested in recording in public areas.
They briefly attempt to dismiss concerns about the Younger Abstention, where a federal court has limits on hearing cases that are heard in state court at the same time. The bulk of their argument instead focuses on first amendment claims and LIA’s rights to record under New York City’s “unambiguous” Right to Record Act.
LIA’s attorneys have requested oral arguments on the motion to dismiss as they feel the court would benefit from oral arguments on the First Amendment issues presented by both parties.
