Judge H. Jay Ford III made an unusual move on Thursday in Jose “Chille” DeCastro’s lawsuit against Michael “Blue Bacon” Pierattini (Bacon), Daniel Clement, Kate Peter and David “Team Skeptic” Omo by moving up a hearing date by a day in order to deny a motion by DeCastro.
DeCastro was essentially seeking the Judge Ford rescind his order of monetary sanctions against DeCastro, admit his court lacked jurisdiction to enforce said sanctions and apologize or give DeCastro a hearing where he could argue his points in front of the Judge.
The motion by DeCastro essentially eviscerated the Judge for his tentative ruling earlier in the month and claimed that the Judge lacked authority to issue sanctions. However, it contradicted an earlier filing by DeCastro that argued many of the same points but demanded sanctions against Bacon of $4999.99.
New Sanctions Demand in DeCastro vs. Bacon
Judge Ford took it upon himself to move DeCastro’s scheduled hearing from March 22 to March 21 and issued the following ruling:
The Ex Parte Motion For Clarification; Motion To Reconsider Motion For Sanctions Or In The Alternative For Factual Findings filed by Jose Decastro on 03/19/2024 is Denied. The declaration in support of the application fails to “make an affirmative factual showing in a declaration containing competent testimony based on personal knowledge of irreparable harm, immediate danger, or any other statutory basis for granting relief ex parte.” CRC Rule 3.1202. Moreover, the requested relief cannot be granted by ex parte application. (CRC Rule 3.1203(a); CCP §1005(a)(13).
It is unclear when DeCastro will see Judge Ford’s ruling as it was sent to his e-mail addresses and DeCastro reportedly does not have access to e-mail from the Clark County, Nevada, Detention Center, where he will be incarcerated until August.
As DeCastro’s incarceration continues his DeleteLawZ.com site remains down, and the controversial YouTuber has been no longer able to run his “successful Trifold business.” This apparently has caused a refocus among his advisors on earning money though his “LAWYER FUND ONLY” GoFundMe account.
While a previous message on DeCastro’s YouTube Community Page had directed his fans to focus on funding Garrett “Press with Rancor” Van Nett’s GoFundMe, raising $85.00 in new donations for the Michigan based auditor, a new posting on DeCastro’s Community Page seems to be making a direct appeal for funds on behalf of DeCastro.
DeCastro’s “LAWYER FUND ONLY” has made roughly $1,200.00 in the three days since his incarceration.
