It was good news for YouTuber SeanPaul “Long Island Audit” Reyes (LIA) on Friday as the United States Court of Appeals for the Second Circuit announced that it would lift a stay put on the preliminary injunction on a NYPD policy preventing filming in NYPD facilities.
The stay was issued by Judge Jessica G.L. Clarke in November after she issued a preliminary injunction blocking the NYPD’s policy to trespass individuals who recorded in NYPD facilities after the defense appealed the injunction to the Second Circuit and LIA’s lawyers appealed the stay as well.
Friday’s ruling only applies to LIA, making him the only citizen in America with the ability to record within police precincts in the city until the Second Circuit finishes its deliberations in the case and makes a final decision.
LIA’s lawyer indicated that his client would honor the previous 48-hour period that both sides had agreed to accommodate the lifting of the stay and implementing the temporary ban of the policy within the city. As it currently stands, LIA will attempt to randomly audit a NYPD precinct on Sunday afternoon.
While the NYPD has requested that LIA show identification so they can properly accommodate his rights, LIA is refusing to do so, stating that members of the NYPD can watch his videos in order to identify him.
An appeal to Judge Clarke for clarification by the defense in the case has gone unanswered as of press time.
There has also been no reaction from LIA rival Jose “Chille” DeCastro, who called out LIA in recent broadcasts for “doing nothing” to help his fellow man. DeCastro cited his fund-raising efforts on behalf of Garret “Press with Rancor” and Craig Hendry as examples of how he has maintained his position as “greatest auditor in America” while LIA has done nothing in response.
While DeCastro had been positive about LIA’s efforts to abolish the limits on recording in NYPD precincts in the past, he has since soured on LIA and taken up a one-sided rivalry to establish himself as the alpha auditor in the United States.
Friday’s ruling, which gives LIA unprecedented powers over the NYPD, may be the end to the long-standing rivalry between the men as DeCastro has apparently been left behind in the race for supremacy in the New York area auditing scene.
